6.1 Idea Submission Policy

For this reason, we do not accept unsolicited ideas, concepts, suggestions, proposals, creative works, inventions, business plans, product concepts, or other submissions ("Ideas").

Please do not submit unsolicited Ideas to us.

If you nevertheless submit an Idea, you agree that:

We have no obligation to review, evaluate, or implement the Idea;
We have no obligation to maintain confidentiality;
We may already be developing or considering similar concepts;
We may use, modify, develop, publish, commercialize, or otherwise exploit the Idea without restriction or compensation.

All unsolicited Ideas shall be deemed non-confidential and non-proprietary.

6.2 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, COMPANY CONTENT, TECHNOLOGY, AND ALL RELATED MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

RAMINJ LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, PARTNERS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WITHOUT LIMITATION, WE DISCLAIM WARRANTIES OF:

MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
TITLE;
NON-INFRINGEMENT;
ACCURACY;
RELIABILITY;
AVAILABILITY;
SECURITY.

We do not guarantee that:

The Services will operate without interruption;
The Services will be error-free;
Defects will be corrected;
The Services are free from viruses or harmful components;
Content is accurate, complete, or current;

PUNITIVE DAMAGES;
EXEMPLARY DAMAGES;
LOSS OF PROFITS;
LOSS OF REVENUE;
LOSS OF BUSINESS OPPORTUNITIES;
LOSS OF DATA;
BUSINESS INTERRUPTION;
PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.

This limitation applies regardless of the legal theory asserted, including contract, tort, negligence, strict liability, statutory claims, or otherwise.

In no event shall our total cumulative liability arising out of or related to the Services exceed one hundred U.S. dollars (USD $100).

The existence of multiple claims shall not increase this limitation.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Raminj LLC, Donut Zoo, and their respective officers, directors, employees, affiliates, contractors, agents, licensors, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

User Content submitted by you;
Your violation of these Terms;
Your violation of any law, regulation, or third-party rights;
Your misuse of Company Content, Technology, or the Services.

We reserve the right, at our own expense, to assume exclusive control of the defense of any matter otherwise subject to indemnification by you.

You agree to cooperate fully in the defense of any such matter.

6.5 Governing Law and Venue

These Terms, the Services, and any dispute arising out of or relating to them shall be governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.

Except where arbitration is required under these Terms, any legal action or proceeding arising out of or relating to the Services shall be brought exclusively in the state or federal courts located within California.

6.6 Dispute Resolution and Arbitration

6.6.1 Agreement to Arbitrate

To the fullest extent permitted by law, you and Raminj LLC agree that any dispute, claim, controversy, or request for relief arising out of or relating to:

The Services;
Company Content;
Technology;
Your relationship with Donut Zoo;

shall be resolved exclusively through binding arbitration rather than in court, except for:

Eligible small claims matters;
Claims involving intellectual property rights;
Requests for injunctive or equitable relief related to misuse of intellectual property.

This arbitration provision applies regardless of whether a claim arises before or after acceptance of these Terms.

6.6.2 Arbitration Procedures

Arbitration shall be governed by the Federal Arbitration Act and administered by the American Arbitration Association ("AAA") under its applicable rules.

Unless otherwise required by applicable law, arbitration shall take place in California or through remote proceedings as determined by the arbitrator.

6.6.3 Arbitrator Authority

The arbitrator shall have exclusive authority to determine:

The scope of this arbitration agreement;
The enforceability of these Terms;
The interpretation of disputed provisions;
Whether claims are subject to arbitration.

The arbitrator may award any relief available under applicable law that would otherwise be available in court on an individual basis.

Any arbitration award shall be final and binding.

6.6.4 Waiver of Jury Trial

YOU AND RAMINJ LLC KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL.

All disputes subject to arbitration shall be resolved by an arbitrator rather than a judge or jury.

6.6.5 Class Action Waiver

ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS.

To the fullest extent permitted by law:

Class actions are prohibited;
Representative actions are prohibited;
Collective actions are prohibited;
Private attorney general actions are prohibited.

You may only pursue claims on your own behalf and not as a plaintiff or class member in any class or representative proceeding.

6.6.6 Time Limitation on Claims

Any claim arising out of or relating to the Services must be initiated within one (1) year after the claim first arose.

Claims not brought within this period shall be permanently barred to the fullest extent permitted by law.

6.6.7 Survival

This arbitration provision shall survive termination of your relationship with Donut Zoo and Raminj LLC.

If any portion of this arbitration section is determined to be unenforceable, the remaining provisions shall continue in full force and effect.

7. Intellectual Property

7.1 Copyright Ownership

Unless otherwise indicated, all content available through the Services, including text, graphics, logos, articles, photographs, illustrations, videos, designs, software, and other materials, is owned by or licensed to Raminj LLC.

All rights are reserved.

No ownership rights are transferred through your use of the Services.

7.2 Trademarks

"Donut Zoo," associated logos, service marks, branding elements, and related identifiers are proprietary trademarks of Raminj LLC.

Nothing contained within the Services grants any license or right to use our trademarks without prior written permission.

Third-party trademarks appearing on the Services remain the property of their respective owners.

7.3 Copyright Complaints (DMCA)

We respect the intellectual property rights of others.

If you believe content available through the Services infringes your copyright, please submit a written notice containing:

Identification of the allegedly infringing material;

A statement made in good faith that the use is unauthorized;
